1. About these terms
These Terms of Use govern access to and use of the i-Mix International website at www.i-mix.ca.
The website is operated by i-Mix International Inc., located at 2 Wyndham St. North, Guelph, Ontario N1H 4E3, Canada. In these terms, "i-Mix," "we," "us" and "our" refer to i-Mix International Inc. "You" refers to the person using the website.
Please read these terms before using the website. By accessing or using it, you agree to these terms. If you do not agree, please discontinue use.
These terms concern the website. They do not replace a separately agreed contract for products, technical services, employment or any other business relationship.
2. Purpose of the website
This website provides information about i-Mix, the industries we serve, our work and technical topics relevant to ingredients and their applications.
Technical material and other website content are provided for general information. They do not constitute an offer to sell, a binding quotation, confirmation of availability or a commitment to supply.
Prices, specifications, quantities, suitability requirements, delivery arrangements and other commercial terms must be agreed separately.
Submitting an inquiry, requesting information or receiving an automated acknowledgement does not create a supply or service agreement.
3. Technical information and application decisions
The website may contain industry information, technical notes, case studies, reference entries, illustrations and explanations of ingredient behaviour, processing conditions and product performance.
This material is general information. It is not a recommendation or specification for your particular product, process or facility.
Ingredient performance depends on factors that website content cannot fully account for, including raw materials, formulation, dosage, processing conditions, equipment, packaging, storage, shelf life and the applicable regulatory framework.
Temperatures, pH values, percentages, dosage ranges and other figures must be read in their stated context. They must not be treated as universal operating limits, approved specifications or guaranteed results.
Examples, case studies and reported outcomes do not guarantee that the same approach will produce the same result in another application. References to research should be read alongside the original source, its methods and its limitations.
Before adopting an ingredient, formulation or process described on this website, you are responsible for carrying out appropriate trials, testing, risk assessment and regulatory verification for your application.
Website content is not a substitute for product-specific technical assessment, food-safety controls or professional regulatory advice.
If you require support for a particular application, contact us so that its requirements and the scope of any assistance can be considered separately.
4. Regulatory compliance
Ingredient permissions, permitted uses, maximum levels, labelling requirements and other regulatory conditions differ between markets and may change.
You are responsible for verifying the requirements applicable to your finished product and the markets in which it will be manufactured, distributed or sold.
Nothing on this website constitutes regulatory approval or a certification of compliance. Any application-specific regulatory guidance must be assessed against the relevant current requirements.
Nothing in these terms removes or transfers a legal obligation that applies to i-Mix in its own capacity as a supplier or service provider.
5. Intellectual property and permitted use
Copyright, trademark and other intellectual property rights in website materials remain with their respective rights holders. These terms do not claim ownership of third-party materials or grant rights that i-Mix does not hold.
You may browse the website, link to its public pages and, where i-Mix holds the necessary rights, download or print reasonable extracts for internal business evaluation or personal reference. Please retain attribution, copyright notices and relevant qualifications, and do not present extracts in a misleading context.
Except where permitted by applicable law, an expressly stated licence or written permission from the relevant rights holder, you must not:
- Republish or commercially distribute substantial portions of the website.
- Present website content as your own work.
- Remove copyright, attribution or other rights notices.
- Use the i-Mix name or logo in a way that suggests an unauthorised affiliation, endorsement or approval.
- Reuse third-party photographs, illustrations or other assets without the necessary permission.
Any separately stated licence for a particular item governs use of that item. Nothing in these terms restricts a use permitted by applicable copyright law.
6. Acceptable use
You must use the website lawfully and without interfering with its operation or another person's access.
You must not:
- Attempt to gain unauthorised access to systems, accounts or non-public information.
- Introduce malicious code or submit harmful files.
- Circumvent security controls or deliberately overload the website.
- Use forms to send spam, fraudulent inquiries, unlawful material or impersonated communications.
- Collect personal information from the website for unlawful purposes.
- Conduct intrusive security testing without prior written authorisation.
We may restrict access where reasonably necessary to address misuse, protect security or comply with legal obligations.
7. Inquiries, applications and other submissions
When submitting information, you must provide details that are accurate to the best of your knowledge and that you are authorised to share.
Do not submit another person's personal information unless you have an appropriate basis for doing so.
Please do not send confidential formulations, detailed proprietary specifications, trade secrets or unnecessary sensitive personal information through public website forms. Contact us first to agree an appropriate method and any necessary confidentiality arrangements.
Submitting material does not transfer ownership of it to i-Mix. It allows us to receive and use it as reasonably necessary to assess and respond to the inquiry or application, subject to applicable law and our Privacy Policy.
Submitting a job application does not guarantee an interview, employment or consideration for a particular role. Any employment offer must be communicated separately.
8. Privacy
We use submitted details to respond to inquiries and review applications, and essential connection information to deliver and protect the site. With your confirmed choices, optional reports may include on-site pages, clicks, scroll depth, active time, form events, referring website, campaign source, browser and device details, connection IP and approximate network location. Optional context is sent only with a form submission and reports expire within 90 days. Manage optional categories through Privacy choices at the top of this page. Our Privacy Policy explains purposes, recipients, retention and your rights. These terms do not activate optional recording. For access, correction or deletion requests, contact hello@i-mix.ca.
9. Availability, accuracy and external links
We aim to provide useful and accurate information, but website content may contain errors, become outdated or require clarification. We may correct, update or remove content.
To the extent permitted by applicable law, the website and its general informational content are provided on an "as available" and "as is" basis. We do not warrant uninterrupted access, freedom from errors or harmful code, or suitability of general website content for a particular application.
This does not alter an express commitment made in a separate agreement with i-Mix.
Links to external websites are provided for reference or convenience. We do not control those websites. A link does not, by itself, constitute endorsement of their content, products or services. Their own terms and privacy policies apply.
10. Limitation of liability
Please read this section carefully. It limits certain types of liability arising from use of this website.
To the extent permitted by applicable law, i-Mix International Inc. and its directors, officers, employees and representatives will not be liable for indirect, incidental, special or consequential losses arising from access to, inability to access, or use of this website or its general informational content.
This exclusion includes lost profits, lost business opportunities, business interruption, production losses and loss of data where those losses are indirect, incidental, special or consequential. It applies whether a claim is framed in contract, negligence or another legal basis, and whether or not the possibility of the loss was identified in advance.
This section concerns use of the website. It does not replace the allocation of responsibility in a separate agreement for products or services.
Subject to the exceptions below and to the maximum extent permitted by applicable law, the total aggregate liability of i-Mix International Inc. and its directors, officers, employees and representatives to you, collectively, for all claims arising from your access to, use of, or inability to use this website or its general informational content shall not exceed CAD 1,000. This limit applies regardless of whether a claim arises in contract, negligence or otherwise.
This cap applies only to website-related claims. It does not limit liability arising from the supply of products or the provision of services under a separate agreement.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not permit to be excluded or limited.
Any mandatory statutory rights, warranties or remedies remain unaffected. Where a limitation is not permitted, liability will be determined under the applicable law.
11. Governing law and disputes
These terms and disputes arising from use of this website are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, subject to any mandatory protections that apply in another jurisdiction.
The courts of Ontario, Canada have non-exclusive jurisdiction over disputes concerning these terms or use of the website.
Nothing in this section prevents you from bringing a claim before another court or authority where applicable law gives you a right to do so. These terms do not require mandatory arbitration or waive a statutory right to participate in legal proceedings.
The governing law and dispute arrangements for a separate supply, service or employment agreement are determined by that agreement and applicable law.
12. Changes to these terms
We may revise these terms to reflect changes to the website, our operations or applicable requirements. When we do, we will update the date shown at the top of this page.
Revised terms apply to use of the website after they are published, subject to any additional notice or consent required by law.
Changes do not retrospectively alter a separate agreement, an accrued claim or a right that cannot lawfully be changed in this way.
13. Relationship with other agreements
These terms apply only to access to and use of the website.
Where a separate agreement with i-Mix addresses the same subject and conflicts with these terms, that agreement governs its subject matter.
If a provision of these terms is found invalid or unenforceable, it will be separated to the extent necessary, and the remaining provisions will continue to apply where legally permissible.
A delay or failure to exercise a right does not, by itself, waive that right.
